Once you have determined that you have something that can be trademarked, it is time to go through the different steps to get this done. There will be a number of different forms and papers that you will need to file to get this done, but knowing how to get started, and even having a professional work alongside you, can make a difference. Some of the different steps that you can take when it is time to get a trademark include:   # Identify the trademark: You will need to start with a bit of research. This is done to help you decide how to protect the mark. You can look at the USPTO database to see if there are some similar goods, designs, or words that are seeking to trademark and are already in use. Then you can look at which mark format you would like, specify the exact goods and services you want to trademark, and then pick which filing basis you would like to work on. # Submit the application: You will need to create your USPTO account. Then it is time to prepare and submit the application online. There will be some fees, between $250 to $350 depending on the class that you would like to work with. You need to pay these before proceeding. # Wait for approval: After you have filled out the form well, it is time to wait for approval. You will get a letter that lets you know. If you are approved, you will find that the mark is then published in the Official Gazette, which is a weekly newsletter that the USPTO will assign. If someone believes that they will be harmed by the mark will have 30 days to file an opposition. If no opposition happens, your mark is registered. # Complete the final paperwork: At this point, you will need to keep up with the registration to make sure you keep your trademark. You will need to do specific documents and then have an annual check to ensure that the trademark is not going to expire.
